1. Definitions and formation of contract
In this document:
“Conditions” means the terms, conditions and other provisions set out in this document. “Edge” or “we” means Edge Hybrid Ltd, registered in England No. 15469624 with registered office at 53b St. John's Road, London, England, SW11 1QW, and any personal pronouns related to “we” shall be construed accordingly.“Edge’s Services” means the services provided through Edge’s mobile phone application and/or website and all other services offered by Edge, including those described in section 2 below.“User” or “you” means any person accessing or using Edge’s Services, whether as a subscriber, member, browser, visitor or otherwise, and any personal pronouns related to “you” shall be construed accordingly.These Conditions apply to all Users, and to all contractual relationships arising between Edge and Users.By opening an account with Edge, or by accessing or using Edge’s Services you agree to be bound by these Conditions.We may amend these Conditions at any time, and the current version will always apply and is available on our app or website. Your continued use of Edge’s Services constitutes acceptance of such amended Conditions.All contractual relationships between Edge and Users, and any dispute or matter arising from such relationships or relating to their subject matter will be governed by and construed in accordance with the laws of England. You submit irrevocably to the exclusive jurisdiction of the English courts in respect of any such dispute or matter.
2. Edge’s Services, limitations, exclusions, and User’s responsibilities
Edge provides and operates a mobile phone application and/or website which recommends personalised fitness training plans, routines and workouts. Edge’s recommendations are provided for informational and educational purposes only, and are not, and are not a substitute for, medical advice, diagnosis or treatment, or professional strength or fitness coaching.You must be at least 18 years old to download the Edge app, open an account with Edge, or access and use Edge’s Services. By opening an account with us, or otherwise accessing Edge’s Services, you warrant and undertake that you are at least 18 years old. If we reasonably believe you are not at least 18 years old we may delete your account and all associated data.Edge does not perform any health or physical assessment of User, and it is entirely your responsibility to assess and consider your own personal circumstances (and any changes to them) and decide whether Edge’s recommendations are safe, suitable and appropriate for you. This includes your age, physical characteristics, level of fitness, health and any existing conditions and risk factors, medication, family medical history, and all other factors relevant to your decision to implement or continue Edge’s recommendations.Before implementing or continuing with Edge’s recommendations you should obtain such medical advice as may be sensible, appropriate and relevant about any medical conditions or concerns that you have.Edge’s recommendations are based on generic information and may incorporate some personal information provided by User. You must ensure that all relevant personal information is provided and is accurate and kept up to date.Edge’s Services may be withdrawn, suspended, amended, or updated from time to time at our sole discretion.If Edge becomes aware that any User has or may have breached these Conditions it shall take such steps as it considers appropriate, which may include further investigation, suspension or termination of your account, blocking of services, removal of content, and such other legal and practical steps as we consider appropriate. If we suspect criminal activity this may be reported to the appropriate authorities. Any decision about whether User content uploaded to our platform infringes these Conditions is at our sole and absolute discretion. If we suspect criminal activity this may be reported to the appropriate authorities.
3. Terms of Use
The email address you provide when creating an account must be and remain an active email address, which is regularly checked. You must keep all your personal information in your account up to date, accurate and complete.You are responsible for all activity that occurs within your account, and you must take all normal and sensible precautions including keeping your login details confidential and using a strong password.If you consider your account has been violated in any way, please contact us and we will investigate and take any appropriate action, which may include suspending or closing your account.You must not hold more than one account on our platform.You may not transfer your account to another person, or allow another person to use your account.You must not upload to, or send via, our platform any content that is unlawful, contains nudity or violence, is abusive, bullying, threatening, harassing, obscene, discriminatory, misleading, untrue, offensive, defamatory, derogatory, rude or hurtful, or that damages the Edge brand, image or reputation.All communications with us and between Users, whether via our app, email or otherwise, must be undertaken with common courtesy, common sense and good judgement, and must not be in any way offensive, aggressive, hostile or abusive.You are solely responsible for your communications with other Users, whether via our platforms or otherwise. Edge is not liable for any communications or contact between Users, nor for any content posted by Users.You must not abuse our ratings and feedback system, or give unfair, inaccurate or unrepresentative ratings.You must not in any way hack, or tamper or interfere with the technical functionalities and content on our platform, and must not steal or wrongly access data or undertake any activity that may be illegal or may affect the provision of our service.You must not circumvent or seek to circumvent any Edge systems that are put in place for privacy or data protection reasons.Our platform may contain anti-spam measures which may be triggered in certain circumstances. Your account may be automatically suspended and we will be notified and will investigate and take appropriate action. If you believe your account has been wrongly suspended please contact us and we will investigate.If for any reason you wish to cease using our platform, please contact us and we will deactivate your account.
4. Subscriptions and Payment
Subscriptions and other payments to Edge for Edges Services will be processed and paid for within our app, through the relevant Apple or Android payment processing system. If you cancel within an agreed, or legally compulsory, cooling off period, we will refund any payment that relates to the period after cancellation, or is otherwise legally due to you. If we offer, and you take up, a free introductory period or use a discount or referral code (including arising from your introduction through a third party) then at the end of the free or discounted period you will automatically move on to a subscription basis as set out in the terms of the introductory offer or discount or referral code. If you cancel during a period that you have already paid for, that cancellation will only take effect at the end of that period, and no refund will be paid.
5. Liability, Indemnity and Disclaimer
1. You acknowledge that physical training activities carry inherent and significant risks of property damage, bodily injury or death. You agree, to the maximum extent permitted by any applicable law, that you understand and accept all known and unknown risks associated with such activities. To the greatest extent permitted by any applicable law Edge excludes, and you indemnify Edge and its officers, employees, shareholders, agents and representatives against, all liability for death, injury, loss and damage whatsoever and howsoever arising, and whether direct or indirect, from Edge’s Services, even if arising from or caused in whole or in part by Edge’s Services, and/or by the action, inaction or negligence of Edge.You indemnify Edge and its officers, employees, shareholders, agents and representatives against any loss, damage, liability, costs or expenses arising from your breach of these Conditions or arising from your negligence.To the fullest extent permissible under applicable law, Edge disclaims any and all warranties and representations about Edge’s Services, express or implied, including (without limitation) in relation to merchantability or fitness for a particular purpose. Edge’s Services, app and website and all their contents are provided on an “as is” basis and your use of them is at your own risk.Our liability to you in connection with your use of Edge’s Services is limited as much as is permitted by any applicable law. We are not responsible or liable for any consequential, special, indirect or incidental damages arising out of your use of Edge’s Services, even if we know that such losses might arise. Our total liability to you will not exceed the greater of GBP 100 and the amount you have paid to us in the 6 months before the claim arose.
6. Privacy
Edge values your privacy and we encourage you to review our Privacy Policy, outlining how your information is used, collected and shared. Our cookie policy also will provide guidance on how cookies are used on Edge.Edge’s Services may include integration with third party products and services. Such connections are additional to and not part of our core service, and are reliant on a third party, therefore we do not accept any responsibility for such connections and any consequences of using them, and such connections may stop working or be discontinued at any time. Linking Edge App with any third party links such as but not limited to Instagram, Facebook or X will be solely at your own risk and it is your responsibility as a User to make sure the content is compliant with that third party’s terms and conditions. Any loss, damage or content that stems from linked third-party sites is not Edge’s responsibility and we are therefore not liable for any consequences of this. Edge is not liable for any loss or damage that may arise from your use of connected third-party sites or responsible for any of the content that may exist on them.Edge may send you advertising through the app and other methods including but not limited to email.Edge reserves the right to review any messages sent through any of Edge’s Services to ensure compliance with these Conditions.
7. Intellectual Property and Permitted Use
Edge owns the intellectual property rights to all the materials and content including but not limited to images, written content and designs on any Edge platform, including each page of the applications and websites. Users do not have any right or licence to use such materials except to the extent implicit in and essential for the delivery of Edge’s Services to the User and any communication activities enabled by those platforms.You agree to use Edge’s Services, our app and website only as permitted by these Conditions and in compliance with all applicable laws, regulations, and generally accepted practices in your country of residence. You may only use Edge’s Services for your personal use and this licence is granted to you on a non-commercial, non-exclusive and non-transferable basis.Any feedback or communication you provide to us about our platform or services is non-proprietary and non-confidential and Edge may use such material in any way it thinks fit and is not liable for any use or disclosure of such material.You must not, and must not attempt to:· modify, adapt, translate, reverse engineer, decompile, disassemble or convert any of the contents of our all or website;· copy, reproduce or otherwise make available any of the contents of our app or website in any form or by any means;· use Edge’s Services, our app or website for any illegal or unlawful purpose;· collect any personally identifiable information via the Site or the Apps for any purpose.
8. Technical matters
Edge takes appropriate measures to prevent any viruses or bugs from entering our platform. We cannot guarantee that our platform will always be secure or free of such viruses or bugs, and we exclude all liability for any losses or damage arising from any breach of security or from viruses or bugs. We also exclude liability for any loss or damage caused to your computer or other equipment by a virus or any other technological harmful material emanating from our platform.Edge seeks to maximise the operating uptime of our platform however we cannot guarantee 100% availability and there may be occasions when services are interrupted for maintenance, updates, power supply and communications issues and other reasons. Edge’s Services may at any time be temporarily or permanently withdrawn without notice and we shall have no liability to you for any consequences.Edge is not liable for any loss of your data or content held on our platforms. We recommend that you keep personal records of any important information, and do not rely on our platform as the only source of such records.
